ATJ 404.4 - EMERGENCY ORDER OF PROTECTION. This Illinois form is used in circuit court to request and issue immediate, short-term protection for a petitioner and other listed protected persons from a respondent who has allegedly committed abuse. It captures case and party information; identifies all people to be protected (including minors, dependent or high-risk adults, and household members); sets the order’s effective dates and the next court hearing; and provides options for how the hearing will be attended (in person or remotely). The order allows the court to impose urgent, police-enforceable remedies—such as prohibiting abuse or contact, granting exclusive possession of a residence, requiring the respondent to stay away from specified places, restricting access to children’s records, barring concealment or removal of children, setting temporary parenting-time restrictions, directing the return or possession of personal property, and protecting animals. In appropriate cases it can also suspend firearm possession, require immediate surrender of firearms, FOID cards, and concealed-carry licenses, and note related civil or criminal proceedings. The form records findings supporting emergency relief without prior notice when necessary, collects information needed for service and identification of the respondent, and includes advisories about penalties for violation and nationwide enforceability under federal law.
