PERA-4 - PETITION UNDER THE PUBLIC EMPLOYE RELATIONS ACT. This form is used to initiate various legal processes concerning public employees’ rights to collective bargaining representation in Pennsylvania. It may be submitted by employees, an employee organization, or a public employer for one of several purposes: (1) to request a representation election where 30% or more of employees desire to be represented by the petitioner; (2) to decertify a current bargaining representative if 30% or more of employees claim the representative no longer reflects their interests, or the employer doubts the representative’s majority status; (3) to request an election by the public employer if a claim for recognition has been made but no election was pursued; (4) to clarify the scope of a previously certified bargaining unit; or (5) to amend an existing certification.
