RI-PR012 - DECLARATION FOR COLLECTION OR TRANSFER OF SMALL ESTATE WITHOUT ADMINISTRATION UNDER PROBATE CODE 13101. This form is used in California to collect or transfer a decedent's personal property without the need for formal probate proceedings. It may be used when the total value of the decedent’s assets in California falls below a specific threshold—$166,250 if the person died before April 1, 2022; $184,500 if they died between April 1, 2022, and March 31, 2025; or $208,850 if the death occurred on or after April 1, 2025. This declaration can only be made if at least 40 days have passed since the decedent’s death and no probate proceeding has been initiated, or if the estate’s personal representative has consented in writing. The form must include a description of the property being claimed, identify the legal successor(s) entitled to the property, and confirm that no one else has a superior claim.
