INITIAL REFERRAL FOR SCREENING FOR PROPOSITION 36. This form used by the San Mateo County Superior Court is designed to initiate the process for eligible defendants to be considered for mental health and/or substance use treatment as an alternative to incarceration under Proposition 36 (2024). This legislation allows individuals charged with drug-related offenses to voluntarily engage in treatment programs if they meet certain criteria: they must consent to treatment, be suitable for mental health or substance use care, and have at least two prior drug-related offenses.
