SJFL-003 - EX PARTE REQUEST AND ORDER TO VACATE TEMPORARY DOMESTIC VIOLENCE/ELDER ABUSE RESTRAINING ORDER. This form is used in the Superior Court of California, County of San Joaquin, by a protected person (the petitioner) who wishes to request that the court cancel or “vacate” a temporary restraining order (TRO) that was previously issued on their behalf. This form allows the petitioner to formally state their desire to terminate the TRO before its expiration date and requires them to confirm that they are making the request voluntarily and without coercion. The petitioner must identify both themselves and the restrained person, provide the dates the TRO was issued and set to expire, and explain their reasons for wanting to vacate the order. The court then reviews the request and issues a ruling, either granting or denying it. If granted, the TRO is vacated in its entirety, meaning any protection for additional parties also ends.
