Description

RI-PR102 - DECLARATION RE: QUALIFICATION TO SERVE AS APPOINTED COUNSEL AT CONSERVATEE’S REQUEST. This form is used in conservatorship proceedings in Riverside County, California. It is completed by an attorney who has been requested or is being considered to represent a proposed conservatee—someone who may be legally deemed unable to manage their own personal or financial affairs. This declaration allows the attorney to affirm, under penalty of perjury, that they are qualified to serve in this role according to court requirements. The attorney must provide details about their licensing status, disciplinary history, professional liability insurance, and relevant experience or specialization in conservatorship, probate, or elder law. If the attorney is not yet highly experienced, they must document supervision or consultation by a more experienced, court-approved attorney and demonstrate steps taken to become sufficiently qualified. The form also asks about prior relationships the attorney may have had with the proposed conservatee or any of the involved parties to determine potential conflicts of interest. Finally, the attorney must acknowledge their role as a zealous, independent advocate for the proposed conservatee, focused on representing the client’s wishes, even if those wishes differ from the attorney’s opinion of the client’s best interests. Approved for Optional Use. Probate Code Section 1471. www.FormsWorkflow.com
