CI-116 - REQUEST TO APPEAR OR ATTEND REMOTELY – CRIMINAL / TRAFFIC. A person may only appear for or attend court remotely if provided by law and if prior express authorization has been granted. (See Local Rules of Court, rule 1.9.) To submit a written request for express authorization using this form, complete and file it with the Monterey County Superior Court no later than close of business two (2) court days before the hearing. For traffic matters, file this form in the Marina Division. For all other criminal matters, file this form in the Salinas Division. An attorney may make a request on another’s behalf by completing and filing this form with the court no later than close of business two (2) court days before the hearing. A person appearing for or attending court remotely must conduct themselves as if they were in person. The court may require an in-person appearance for any of the reasons provided in Penal Code section 977 subd. (f), or to provide for the effective management or orderly conduct of the proceedings. All persons appearing for or attending court remotely must have a sufficiently strong internet connection to ensure clear transmission of audio and video. They must be familiar with the court’s remote application, including having the ability to enable/disable video, mute/unmute audio, and must ensure their full name appears on screen.
