Description

PETITIONER’S MOTION AND DECLARATION FOR LESS RESTRICTIVE TERMS (Sexual Abuse Protective Order). This packet of forms is used to request a change to a Sexual Abuse Protective Order (SAPO) in the state of Oregon. A SAPO is a court order designed to protect individuals from unwanted sexual abuse or contact. Once the initial order has been in effect for at least 30 days without a hearing request from the Respondent—and as long as the order hasn’t expired or been terminated—either party (Petitioner or Respondent) may file a motion to modify the terms of the order. These changes may make the order either less restrictive (for example, allowing certain types of contact or access to specific locations) or more restrictive (tightening or expanding prohibitions). The forms provided in this packet guide both Petitioners and Respondents through the proper procedures for requesting changes, whether they want to initiate the request or respond to one. Included in the packet are instructions for completing and filing motions, declarations explaining the reasons for the changes, and notices to the other party. There are also forms for requesting and scheduling hearings if the other party disagrees with the modification, as well as required documents for legally serving notice of the motion to the opposing party. There are forms to help notify the sheriff’s office of any change in contact information for petitioners who want to receive electronic service updates. The packet contains a certificate of service to confirm that legal notice of the requested changes has been properly delivered. These materials ensure that both parties and the court follow the appropriate process under Oregon law (ORS 163.775) when seeking to modify a SAPO. www.FormsWorkflow.com
