RESPONSE TO PETITION FOR SEPARATION OF MARRIAGE OR RDP. This form is used in the Oregon Circuit Court by a Respondent who wishes to formally respond to a petition for legal separation. The form allows the Respondent to indicate their opposition to specific sections of the Petition and provide explanations for each. It also gives the Respondent the opportunity to make counterclaims, such as requesting spousal or child support, division of retirement benefits, or other relief not included in the original Petition. The Respondent may ask the court to restore a former legal name and request permission to relocate more than 60 miles away from the Petitioner without prior notice. If the Respondent or their children receive Social Security or veterans’ benefits due to the Respondent’s disability or retirement, they can request a dollar-for-dollar reduction in child support. The form includes an optional section to request an exception to the automatic income withholding requirement for child support payments.
