Description
DEFENDANT’S OBJECTION TO PLAINTIFF’S CERTIFICATION COVER SHEET AND REQUEST FOR STAY PURSUANT TO RESIDENTIAL MORTGAGE FORECLOSURE DIVERSION PROGRAM. This form is used in the Court of Common Pleas of Lancaster County, Pennsylvania by homeowners who wish to challenge the plaintiff’s (lender’s) determination that their property is not eligible for participation in the Residential Mortgage Foreclosure Diversion Program. When a foreclosure complaint is filed, the plaintiff must submit a certification cover sheet indicating whether the property qualifies for the diversion program. If the plaintiff claims that the property is ineligible, but the homeowner believes otherwise, this objection form allows the homeowner to formally contest that claim. By completing and submitting this form, the defendant affirms that the property meets the program’s eligibility criteria: it is their primary residence, consists of four or fewer units, has a mortgage balance of $400,000 or less, is not involved in bankruptcy, divorce, or estate proceedings, and the foreclosure action relates to their home. The defendant also requests a stay (a pause) in the foreclosure process so they can participate in the program, which offers opportunities for loan resolution through court-supervised negotiation. www.FormsWorkflow.com
