GAC105 - VISITOR'S REPORT Minn. Stat. §§ 524.5-304(f) and 524.5-406(f) Minn. Gen. R. Prac. 416(b). This form is used in Minnesota in guardianship and conservatorship cases. Appointed by the court, the visitor conducts an in-person interview with the respondent (the person subject to guardianship or conservatorship) and gathers firsthand observations regarding their mental, physical, and living conditions. The visitor evaluates whether the respondent understands the legal proceedings, their rights, and whether they wish to waive or obtain legal representation. The form also documents the respondent’s awareness of time, place, and date, their preferred language, and any need for an interpreter. The visitor gathers information on the respondent’s family relationships, their trust in the proposed guardian or conservator, and their preference for an alternative appointment if applicable. The report assesses the respondent’s ability to make decisions, their current residence, and whether they require assistance with daily living, financial management, or legal matters. Based on the evaluation, the visitor recommends whether a guardianship or conservatorship is necessary, which powers should be granted, and any alternative options that may be considered.
