Description

CIVIL STALKING INJUNCTION. This form is used in the State of Utah to provide legal protection to individuals who are victims of stalking. This form is issued by the District Court after a hearing where the respondent is given notice and an opportunity to be heard. If the court finds reasonable evidence that stalking has occurred—defined as repeated unwanted contact or behavior that causes fear or emotional distress—the judge may grant the injunction. The form identifies the petitioner (the person seeking protection), the respondent (the alleged stalker), and any other individuals who are also to be protected by the order. The injunction may include a range of enforceable provisions, such as prohibiting the respondent from contacting, approaching, harassing, or stalking the petitioner or others listed. It can also bar the respondent from going near the petitioner’s home, workplace, school, vehicle, or other specified locations. In cases involving shared children, it may include temporary custody and parent-time arrangements. Violation of the order is a Class A misdemeanor and may carry enhanced penalties for repeat offenses. The order remains in effect for three years and is enforceable nationwide, including tribal lands and U.S. territories. The form also includes warnings regarding firearms restrictions and emphasizes that only the court can change or dismiss the injunction. www.FormsWorkflow.com
