CM71 - ORDER APPOINTING ATTORNEY AD LITEM. This form is used by the Court of Chancery of the State of Delaware in guardianship proceedings when a petition has been filed to terminate a guardianship due to the alleged recovery of the person with a disability. The court uses this order to appoint an attorney ad litem—an independent attorney tasked with representing the best interests of the person with a disability. The attorney ad litem is directed to investigate whether the individual has regained sufficient capacity to make their own medical and financial decisions. To do this, the attorney is granted full access to the individual’s medical, educational, financial, and social services records, with authorization to obtain confidential information from relevant entities without delay. The investigation may be conducted remotely for convenience or safety, and a written report with the attorney’s findings and recommendations must be submitted to the court within twenty days. The attorney is also authorized to meet with the current guardian, the person with a disability, and other interested parties.
