Description

DLC 4085 - SUMMARY OF TENANCY RIGHTS FORM. This form can be completed in place of submitting a rental/lease agreement. This form is not applicable to applicants that own the real property (location) where the permit is being requested. In order for this form to be deemed completed, it must be signed by the landlord, in the same name as the liquor permit applicant as identified on the application, and for the same address as listed on the liquor permit application. Keep in mind that under Ohio law LLC's and Inc's are separate "persons" meaning that if John or Jane Doe own property in their individual name and they apply for a liquor permit in the name of ABC, Inc or XYZ, LLC (even if they are the respective sole shareholder/member), those are separate people. As such, they need to indicate they do NOT own the property and should submit a lease agreement / tenancy form leasing the property from themselves to the LLC or Inc. This would also apply if you own two separate companies (e.g., you own XYZ, LLC and ABC, Inc.), XYZ, LLC owns the property and ABC, Inc. is the liquor permit applicant.
