PADR-01 - STIPULATION REGARDING ALTERNATIVE DISPUTE RESOLUTION (ADR). This is a mandatory court form used in the Superior Court of California, County of Fresno to formalize an agreement between parties to participate in an Alternative Dispute Resolution (ADR) process such as mediation, arbitration, or neutral case evaluation. The form records the selected ADR process, identifies the chosen mediator, arbitrator, or neutral evaluator, and includes their contact information. By signing, the parties acknowledge their obligation to complete ADR before the Mandatory Settlement Conference (MSC). Failure to complete ADR or to provide a written declaration showing good cause may result in the cancellation of the MSC and the imposition of court-ordered sanctions. All parties are required to file an Alternative Dispute Resolution (ADR) Status Report at least ten (10) court days prior to the MSC. Failure to submit the report may lead to sanctions or an Order to Show Cause (OSC) hearing. Each party or their attorney must date and sign the form, confirming agreement to ADR participation and compliance with Fresno County Superior Court’s standing ADR requirements.
