EX PARTE CHILD PROTECTIVE ORDER. This form is used in the Utah District Juvenile Court to provide immediate legal protection for children who are alleged to be abused or in imminent danger of abuse. This order is issued without prior notice to the respondent and is based on a petition filed by a person with an interest in the child’s safety, usually after making a referral to the Division of Child and Family Services (DCFS). The order may prohibit the respondent from committing or threatening abuse, contacting the children, or coming near their home, school, place of worship, or other frequent locations. It can also restrict the respondent from possessing weapons, award temporary custody, regulate parent-time, prohibit drug or alcohol use during parent-time, and prevent the removal of children from Utah. In foster care cases, the order may authorize removal of children from the home if remaining there is contrary to their welfare. Law enforcement is empowered to enforce the order, assist in regaining custody, and protect the children and petitioner.
