QUALIFIED PROTECTIVE ORDER FOR PROTECTED HEALTH INFORMATION (KAREN L. McNAUGHT UNITED STATES MAGISTRATE JUDGE). This is a standard order issued by Magistrate Judge Karen L. McNaught of the U.S. District Court for the Central District of Illinois to ensure compliance with the Health Insurance Portability and Accountability Act (HIPAA) during litigation. Authorized under 45 C.F.R. §164.512(e)(1), it permits parties and their attorneys to obtain and use protected health information (PHI) strictly for purposes related to the lawsuit, including discovery, trial preparation, and appeal. The order prohibits disclosure or use of PHI outside the case, outlines who may access it (such as counsel, experts, insurers, and court personnel), and requires that all PHI be destroyed or returned within 45 days after litigation concludes.
