Form 36 - WAGE DEDUCTION SUMMONS. This form is used in the Circuit Court for the Seventh Judicial Circuit of Illinois, Sangamon County. It is issued to an employer when a judgment has been entered against an employee (the defendant) to begin the process of garnishing wages. The summons requires the employer to file answers to interrogatories about the employee’s wages and to withhold non-exempt wages that are due at the time of service and those earned afterward until the judgment is satisfied. Employers are warned that failure to respond may result in a conditional judgment by default against them for the amount owed. The form also includes instructions for federal agency employers, directing them to begin paying over deducted wages immediately in compliance with federal and state law.
