Description

JDF 352 - MOTION AND AFFIDAVIT TO OPEN ADOPTION FILE BY: ADULT DESCENDANT OF ADOPTEE; LEGAL GUARDIAN OF ADOPTEE; SPOUSE OF ADOPTEE; ADULT DESCENDENT OF ADOPTIVE PARENT; ADULT STEPCHILD OF ADOPTEE; OR ADOPTED ADULT SIBLING OF ADOPTEE. This form is used in Colorado by individuals who are closely related to an adoptee and wish to access sealed adoption records. This specific version of the form may be used by an adult descendant of the adoptee, the legal guardian or spouse of the adoptee, an adult descendant of an adoptive parent, an adult stepchild of the adoptee, or an adopted adult sibling of the adoptee. The purpose of the form is to formally request that the court open adoption files to allow a confidential intermediary to review them and possibly initiate contact with the adoptee’s birth relatives or gather information relevant to the petitioner’s relationship or family history. The petitioner must provide personal and identifying information about themselves and the adoptee, including birth dates, addresses, and the relationship between the parties. Additional details such as the adoption date, county of finalization, the agency and attorney involved, and known facts about the adoptee’s birth family are also required. Depending on the petitioner’s role, they must complete a relevant section that outlines their specific connection to the adoptee or adoptive family. The completed affidavit is submitted to the court to obtain judicial approval for the sealed records to be accessed and used by a confidential intermediary, who is authorized to handle these sensitive matters while maintaining confidentiality. The petitioner signs the form under penalty of perjury, certifying that the information provided is true and that their request is being made for lawful and informed reasons. www.FormsWorkflow.com
