CV/E-208 - DECLARATION OF DILIGENT SEARCH AND REQUEST TO DISPENSE WITH NOTICE RE: PETITION FOR CHANGE OF NAME. This is a Sacramento County Superior Court form used in name-change cases involving a minor when the non-consenting parent cannot be located. California Code of Civil Procedure 1277(a)(4) requires that if a petition has been filed for a minor by a parent and the other parent, if living, does not consent, the other parent must be served with notice of the name change. When the address of such a person is unknown and cannot be located, the Court may excuse notice upon a showing of a diligent search. The form prompts the petitioner to provide the last known address of the parent, describe all search efforts—including contacts with relatives, friends, employers, directory searches, public record searches, internet research, and criminal justice inquiries—and explain any additional relevant information.
