FORM PB-904 CHECKLIST: INITIATING APPOINTMENT (Formal Appointment/Intestate Estate) A. Preparation of Documents: Prior to appointment hearing, prepare the following documents: 1. Petition for Adjudication of Intestacy, Determination of Heirs and Appointment of Personal Representative (Form PB-114). 2. Waiver(s) of Bond (Form PB-2). cannot be waived, obtain bond. If bond 3. Notice of Hearing on Petition for Adjudication of Intestacy, Determination of Heirs and Appointment of Personal Representative (for mailing) (Form PB-720). 4. Proof of Notice (Form PB-718). (Set forth persons to whom notice will be sent.) 5. Notice of Hearing on Petition for Adjudication of Intestacy, Determination of Heirs and Appointment of Personal Representative (for publication) (Form PB-720). 6. Order of Intestacy, Determination of Heirs and Appointment of Personal Representative (Form PB-118). 7. Acceptance of Appointment as Personal Representative (Form PB-107) 8. Letters of Personal Representative (Form PB-108) 9. Notice of Fiduciary Relationship (I.R.S. Form 56). 10. 11. 12. Notice of Assumption of Duties in a Fiduciary Capacity (Ariz. Form ADFC). Application for Employer Identification Number (I.R.S. Form SS-4). Notice to Creditors (Forms PB-301 and PB-302). B. Obtain all necessary signatures from petitioner (and American LegalNet, Inc. www.FormsWorkflow.com personal representative if they are different people). C. File with court: 1. Petition; 2. Waiver(s) of Bond (if any); and Filing fee. In Pima County, Notice of Hearing. D. Call court administrator's office to obtain hearing date. (14-day minimum notice period is required, but use 21-day period for safety purposes.) Insert date on Notice to be sent to interested persons and Notice for publication. In Pima County, calendar services will write in hearing date after the case has been filed and a case number obtained. E. Immediately send Notice to interested persons and file original Notice and Proof of Notice with the court. (Notice must be mailed at least 14 days before the hearing.) F. Send a copy of the Notice for publication to the publisher. (Notice must be published 1 time at least 14 days before the hearing.) G. When Affidavit of Publication is received from publisher, immediately file or lodge Affidavit and original Notice (for publication) with the court. H. Hearing: Take to the hearing the original Order and Letters and at least 1 copy of each to be conformed for firm file. Order will be signed by judge or commissioner.
