62.210 Malicious Arrest; Generally An arrest under process of law, without probable cause, when made maliciously, shall give a right of action to the party arrested. O.C.G.A. §51-7-1 An action for malicious arrest is based upon an arrest in a civil action under process of law but maliciously and without probable cause. To authorize a recovery, it must appear that the plaintiff was arrested under some kind of process in a civil action, that the action was brought maliciously and without probable cause, and that the prosecution terminated in favor of the plaintiff.
