14.240 Condemnation; Fair Market Value Not Necessarily Same as Actual Value (This charge should be used only when authorized by the evidence.) Although fair market value is ordinarily the same as actual value, there may be circumstances in which it may not be the same, and under those circumstances your measure of damage would be actual value.
