00.060 Conflicts in Evidence While you are determining the facts of this case, you may find that there are conflicts in the evidence. If you do find conflicts in the evidence, it would be your duty under the law to reconcile these conflicts, if possible. You should reconcile these conflicts so as not to attribute perjury or false statements to anyone. You should reconcile these conflicts, if you can, as if each witness had spoken the truth. As you know, very often one person will see things and remember things a little differently from someone else. This does not necessarily mean that one person is not truthful. It may mean only that each witness's recollections or perspectives are somewhat different. If you find any parts of the evidence are in such conflict as to make it impossible for you to reconcile them, then you must believe that evidence that seems most reasonable, probable, and truthful to you because you, the jury, must determine the witnesses' credibility and the reasonableness of their testimony.
