Instruction No 1 33.04 [1995 Revision] Converse Instructions--Instructions Conversing Verdict Directing 17.02 Using "Unless You Believe" Introduction 33.04(1) (Conversing Negligence) Your verdict must be for defendant unless you believe defendant was negligent [as submitted in Instruction Number ]. 33.04(2) (Conversing Damages) Your verdict must be for defendant unless you believe plaintiff sustained damage. 33.04(3) (Conversing Causation) Your verdict must be for defendant unless you believe that as a direct result of defendant's negligence [as submitted in Instruction Number ], plaintiff sustained damage. 33.04(4) (Conversing Damages and Causation) Your verdict must be for defendant unless you believe defendant was negligent [as submitted in Instruction Number ], and as a direct result of such negligence, plaintiff sustained damage. 33.04(5) (Conversing All Disjunctive Specifications of Negligence) Your verdict must be for defendant unless you believe either defendant failed to keep a careful lookout, or defendant drove at an excessive speed, or defendant's automobile was on the wrong side of the road. 33.04(6) (Conversing Causation Submitted With MAI 19.01 (First Alternate)) Your verdict must be for defendant unless you believe that defendant's negligence [as submitted in Instruction Number ] directly caused or directly contributed to cause damage to plaintiff. 33.04(7) (First Alternate)) (Conversing Negligence and Causation Submitted With MAI 19.01 Your verdict must be for defendant unless you believe that defendant was negligent [as submitted in Instruction Number ] and such negligence directly caused or directly contributed to cause damage to plaintiff.
