Instruction No 1 31.21 [1995 New] Verdict Directing--Partial Invalidity of Will Due to Fraud In your verdict, you must find that the contested part of the last will and testament of (name of testator ) providing for (here insert description of the challenged provision of the will ) is not valid if you believe: First, (insert name of person committing fraud ) represented to (name of testator ) that (here state the allegedly false representation ), and Second, such representation was false, and Third, (insert name of person committing fraud ) knew such representation was false, and Fourth, such representation was intended to and did deceive (name of testator ), and Fifth, (name of testator ) relied upon such representation, and Sixth, (name of testator ) was induced to include the contested part of the will by reason of such representation.
