Instruction No 1 21.06 [1991 New] Limiting Instruction--Actions Against Health Care Providers--Settling Tortfeasor If a released person is included in the verdict form, and the jury has knowledge from the evidence or a trial incident of a release or payment pursuant to a release, the following instruction should be given as a separate instruction: Plaintiff's claim against (name of released party ) has been settled. In determining the total amount of plaintiff's damages and in assessing percentages of fault, you are not to consider such settlement. The total damages assessed by you on plaintiff's claim against the defendant(s) (or state the names of the defendant(s) ) will be reduced by the judge by any percentage of fault you assess to (state the name or names of the released parties ).
