Instruction No 1 13.03 [1990 Revision] Definition--Agency--Scope of Employment--Dual Purpose Acts Acts were within the "scope and course of employment" as that phrase is used in this [these] instruction[s] if: 1. they were done by (name of servant) partially to serve the [business] [interests] of (name of master) and partially to carry out the [business] [interests] of (here insert name of servant or such other party as is appropriate ), and 2. (master's) business created the necessity for the trip, and 3. (name of master) either controlled or had the right to control the physical conduct of (name of servant).
