American LegalNet, Inc. www.FormsWorkFlow.com INSTRUCTIONS INFORMATION REGARDING USE OF RELEASE OF MECHANIC'S LIEN When a mechanic's lien is recorded in the office of the County Recorder of the country in which the job is located, it creates a ''cloud'' on the title. This means that any person seaching the title will discover the claim of lien and generally will not purchase, refinance, or accept the property as security for a debt without having the owner ''clear up'' the title. The simplest way to clear up the title is for the lien claimant to sign and record a release of his claim. This is generally done after payment of the claim. REMEMBER, mere satisfaction of the claim does not remove a recorded claim of lien from the official records of the county. A formal document, such as Form 109, must be recorded to become part of the official records. UNENFORCEABLE LIENS There are times when a mechanic's lien claim is unenforcable (for example, if the claim of lien was not filed within the time allowed by law). However, it may still be a ''cloud'' on the title. The ''cloud'' can be removed by recording a release of the claim. RECORDING INFORMATION The mechanic's lien release must be recorded in the county where the job is located. The current fee for recording one page is $2.00, plus .80c for each additional page or fraction thereof. However, this price is subject to change and should be checked with the County Recorder's Office, since the recorder will not record a document unless it is accompanied by the correct fee.
