170.04 Safety Appliance Act--Boiler Inspection Act--No Assumption of Risk by Employee At the time of the occurrence there was in force a federal statute known as the [Safety Appliance Act] [Boiler Inspection Act] which provided that in any action brought against a railroad to recover damages for [injury to] [the death of] an employee, the employee shall not be held to have assumed the risks of his employment in any case where the violation by the railroad of the Act caused, in whole or in part, the [injury to] [death of] the employee.
