5.2 CRIMINAL SOLICITATION 777.04(2), Fla. Stat To prove the crime of Criminal Solicitation, the State must prove the following two elements beyond a reasonable doubt: 1. [Name of defendant] solicited [name of alleged person] to commit [offence solicited.] 2. During the solicitation, the [name of defendant] [commanded] [encouraged] [hired] [requested] [namto engage in specific conduct, which e of alleged person] would constitute the commission of [offence solicited] or an attempt to commit [offence solicited.] name of de fendant] do any act in furtherance of the [offence solicited.] NOTE TO JUDGE: Define the crime solicited. If it is burglary, also define the crime that was the objburglary. Also define attempect of the t. To "solicit" means to ask earnestly oto try to inr duce the person solicited to do the thing solicited. It is a defense to the charge of criminal solicitation if [name of defendant], after o ffence solicited], persuaded [alleged person] not to do so, or otherwise prevented commission of the offense.
