As of January 1, 2010, you have a right to receive notice of the Mental Health Facility Director's decision to release him or her because such person is no longer in need of hospitalization to protect him or herself or another from harm. You are entitled to receive this notice at least 48 hours prior to the intended discharge (405 ILCS 5/3-902 (d)). In order to receive such notice, you must notify the Facility Director in writing of your desire to receive this notice. If you fail to make a written request no notice of the decision to discharge the individual will be given to you.
