STATE OF CALIFORNIA DEPARTMENT OF REAL ESTATE Serving Californians Since 1917 CONSENT TO SERVICE OF PROCESS (Public Report or Out-of-State Registration) RE 608 (Rev. 4/09) This form is to be used by non-resident applicants for a subdivision public report or out-of-state registration. Applicant, _____________________________________________________________________________________, a resident (individual) a partnership duly organized and existing under the laws (Partnership) a corporation duly organized and existing under the laws (Corporation) a limited liability company duly organized and existing under state laws (Limited Liability Company) of the State of ______________________ has applied to the Department of Real Estate of the State of California for a subdivision public report or out-of-state registration authorizing the sale or lease of subdivided land identified as ___________ ____________________________________________________________________________________. 1. In any legal action commenced against Applicant in this State arising out of activities related to the above described subdivision, if personal service of process cannot be made upon Applicant in the State after due diligence, Applicant irrevocably consents that service may thereupon be made by delivering the process to the Department of Real Estate of the State of California. 2. The Department of Real Estate shall forthwith notify Applicant by telegraph of any such process and shall forward to Applicant by certified mail a copy of the process.
