O.R.C. sec. 3109.04(E)(1). A court may also modify or terminate an order granting legal custody of a child issued under O.R.C. sections 2151.353, 2151.415, or 2151.417, if it finds a change has occurred in the circumstances of the child, or the legal custodian, and that the modification or termination of the order is necessary to serve the best interest of the child. O.R.C. section 2151.42(B). There has been a change of circumstances for the appropriate party. The changed circumstances and the reason for the modification in the best interests of the child are set forth in the affidavit below and are incorporated herein as if fully rewritten.
