Description

LACIV 096, APPLICATION FOR ISSUANCE OF WRIT OF EXECUTION, POSSESSION OR SALE. This form is used in the Los Angeles County Superior Court in California to request that the court issue a writ of execution, possession, or sale to enforce a money judgment or order. A writ of execution is a court order that directs a law enforcement officer, usually a sheriff, to seize and sell property belonging to the judgment debtor (the person who owes the money) in order to satisfy the judgment. A writ of possession is a court order that directs the sheriff to remove the judgment debtor from a piece of property and return possession to the judgment creditor (the person who won the lawsuit). A writ of sale is a court order that directs the sheriff to sell property belonging to the judgment debtor and apply the proceeds to satisfy the judgment. The Application for Issuance of Writ of Execution, Possession or Sale form requires the judgment creditor to provide information about the original judgment, including the case number and the amount of the judgment. The creditor must also explain the specific property or assets they want to be seized, if applicable, and the reason why they are seeking the writ of execution, possession, or sale. The form also includes sections for the court to approve or deny the request and issue the writ if appropriate. For Optional Use, Code Civ. Proc., § 712.010. www.FormsWorkflow.com
