SUPERIOR COURT OF CALIFORNIA COUNTY OF SANTA CLARA FAMILY LAW DIVISION 170 Park Center Plaza San Jose, California 95113 PETITIONER/PLAINTIFF: FOR COURT USE ONLY RESPONDENT/DEFENDANT: STIPULATION TO TEMPORARY JUDGE (Family Court Settlement Officer) CASE NUMBER: IT IS HEREBY AGREED between the undersigned that all settlement proceedings and other procedural issues, including procedural issues dealing with long cause hearing, procedural issues dealing with trial, and procedural issues dealing with contempt in this matter, may be heard by (____) Edward F. Mills, Family Court Settlement Officer of the Santa Clara County Superior Court or by (____) , acting Family Court Settlement Officer, a member of the bar of this state, in accordance with Rule 244, California Rules of Court, and further in accordance with the appointment of said Family Court Settlement Officer by the Supervising Judge of the Family Law Division of the Superior Court as temporary judge made under the authority of Article 6, Section 21 of said Constitution. Further, it is agreed and stipulated that said temporary judge may hear all other proceedings not specifically objected to in advance by either party, conditioned upon a specific opportunity to so object in advance. We further agree that the Settlement Officer cannot be called as a witness by any party. It is understood that said Edward F Mills/acting Family Court Settlement Officer has previously been appointed to act as temporary judge as to all matters assigned to him by a Judge of this Court for hearing and that he has taken the necessary oath of office as to all matters so assigned.
