Box 30005 Lansing, Michigan 48909-7505 Licensing Division Telephone 517-322-1400 Licensing Division Unit 4 Fax 517-322-6137 TEMPORARY AUTHORIZATION REQUIREMENTS [Authorized by MAC R 436.1023 (2) (3), R 436.1403 (2), R 436.1407 and R 436.1419] GENERAL INSTRUCTIONS This application must be completed and returned with a $70.00 inspection fee for each application submitted before it can be considered by the Commission. All answers must be typed or printed. Sign the completed form in ink and return it to the MLCC with the inspection fee. MAKE ALL CHECKS or MONEY ORDERS PAYABLE TO "STATE OF MICHIGAN". Any changes made to the application after it has been considered by the Commission will require submission of a new application along with a $70.00 inspection fee. A licensee is prohibited from having the outdoor sale, service, and consumption of beer, wine, and/or spirits without the prior written approval of the MLCC. The MLCC may not issue more than 12 daily temporary authorizations to a licensee for each type of temporary authorization requested in a calendar year upon completion of this application and approval of the chief law enforcement officer who has jurisdiction. Please read these instructions carefully to avoid having your application returned to you due to missing or deficient information. Please submit your application at least 10 days prior to the event. 1. To be considered for temporary authorization you must complete all the information in Part 1, indicate the type of event(s) to be conducted in Part 2 and answer all of the questions in Part 3 of the application for the type of temporary authorization requested. A diagram must be included with the application if requesting temporary outdoor service and/or add space You must include dimensions on the diagram. 2. The application form must be signed by the licensee, an authorized corporate officer or an authorized member of a limited liability company in Part 4. Only authorized signors (as indicated on the LC-52, Report of Officers, Directors and Stockholders or the LC-52a, Report of Limited Liability Company Members, Managers & Assignees) may sign the application. Usually a general manager of the licensed business is not an authorized signor. MAKE A COPY OF THIS APPLICATION FOR YOUR FILE. 3. The Police Chief or Sheriff who has jurisdiction must sign the form in Part 4 if approval of this application is recommended. 4. The completed application must be received at least 10 days prior to the date the event is being held or there may not be sufficient time for MLCC review and consideration. 5. If approval is granted, the on-premises license shall not sell, or allow the consumption of alcoholic beverages outdoors, except in the defined area. NOTE: The defined area must include some type of barrier at least 4 feet high. Ropes, tape and banners are not acceptable barriers to adequately secure and define the area. 6. Try to draw the outdoor service or add space diagram to scale, include dimensions, streets, relation to existing licensed premises, etc. The dimensions of the diagram MUST match the dimensions of the outdoor service / add space area included on the application. NOTE: The licensee MUST have control of all intervening property (if any) between the licensed premises and proposed outdoor service or temporary add space. 7. Include the signature of the city, village, or township clerk if the outdoor service or added space will be located on property owned by the city, village, or township. The clerks' signature is MANDATORY for approval. 8. Refrigeration trucks and/or trailers CANNOT include an alcoholic beverage logo and MUST be rented by the licensee from a non-wholesale company. If the refrigeration truck/trailer allows customer access to obtain alcoholic beverages, a Temporary Additional Bar must be requested unless an existing Additional Bar Permit will be used. 9. Check the Temporary Add Bar box and pay the required fee if there is no table service (bar or wait staff) provided unless an existing Additional Bar Permit will be used. The fee covers ALL DATES requested on the application - you do not have to pay the fee for each event. Up to 12 event dates (maximum per calendar year) can be requested on a single application as long as the other criteria remain the same as well. If you have only a SERVICE BAR for employee access and NOT for customer access to alcoholic beverages, it is NOT necessary to request a TEMPORARY ADDITIONAL BAR and the fee is not required.
