INSTRUCTIONS STIPULATION TO ABATE SUPPORT BASED UPON PARTIES' MARRIAGE Information and Instructions for Completion: The Friend of the Court may administratively process an abatement of support for parties of domestic relations cases who marry each other. The process for parties to request such action in Wayne County is as follows: A. Both parties must agree, or stipulate to abate the support, and make a written or in-person request to the Friend of the Court. B. Both parties must sign a notarized Stipulation to Abate Support (attached.) The signatures must be in ink, and the notary mark must be a raised seal. C. A Certificate of Marriage and a valid front and back copy of government-issued identification for both parties must accompany the Stipulation D. The completed stipulation and copy of certificate of marriage must be mailed to, or delivered to: Friend of the Court Customer Service Department 2nd Floor 645 Griswold Detroit, MI 48226 E. A photocopied or faxed stipulation will not be accepted. F. A Friend of the Court caseworker and attorney will review the request and the accompanying documents to determine eligibility for an administrative abatement of support. G. Parties of cases that are deemed ineligible for an administrative abatement of support may request a consent hearing or file a motion before the assigned referee. Both parties will receive a letter explaining the reasons for ineligibility. H. If the case is accepted for abatement of support, a Consent Order for Married Parties will be completed and entered as an order of the court. Both parties will receive a copy of the order and its terms. I. Upon entry of the order, the support and enforcement of current support will cease. Support shall be reinstated if: 1. The payee files a motion to reinstate support 2. The dependent(s) become a recipient of TANF benefits. In the event that the child becomes a recipient of TANF benefits, the support shall be reinstated in the amount last ordered, effective the date the dependent(s) became a beneficiary of public assistance. J. Any arrears that are preserved as part of the order will continue to be enforced by the court.
