ATTACHMENT TO REFEREE RECOMMENDATION AND ORDER NOTICE OF RIGHT TO JUDICIAL HEARING Pursuant to MCL 552.507(4) and MCR 3.215, if you object to the Referee Recommendation and Order, you have a right to a judicial hearing. To request a judicial hearing, you must file objections within 21 days after the Referee Recommendation and Order is served on the attorneys or parties. If no objections are properly filed, the Referee Recommendation and Order will become the final order of the Court. A party or an attorney may object to the Referee Recommendation and Order and request a judicial hearing as follows: If a party requests a judicial hearing, the party must: · Complete the Objection to Referee Recommendation form and make 3 copies. · Serve/mail a copy of the objections form to the other party. · Complete the Certificate of Delivery/Mailing section under the party's signature on the Objection to Referee Recommendation form. · Deliver the completed form and 1 copy to the assigned judge's courtroom. The Court will notify all parties of the date and time for the judicial hearing. If an attorney requests a judicial hearing, same-day judicial hearings may be available. An attorney may inquire from the referee if a same-day judicial hearing is an option. · Judicial hearing on the same day. The attorney must: o Complete the Objection to Referee Recommendation form and make 3 copies. o Serve a copy of the completed objections form on the other party/attorney. o Complete the Certificate of Delivery/Mailing section under the attorney's signature on the Objection to Referee Recommendation form. o Deliver the completed form and 1 copy to the assigned judge's courtroom at the judicial hearing. · Judicial hearing on a subsequent day. The attorney must: o Complete the Objection to Referee Recommendation form and make 3 copies. o Deliver the completed form and 1 copy to the assigned judge's courtroom. The Court will advise of the hearing date and time. o Serve/mail a copy of the Objection to Referee Recommendation form, including completed Notice of Hearing, to the other party. o File proof of service of the Objection and Notice of Hearing with the Court. NOTE: If the Referee Recommendation and Order includes the INTERIM ORDER provision, it is considered effective pending a judicial hearing.
