PETITION INSTRUCTIONS If your liquor license application is for a premises located outside a municipality, you must file a petition. Instructions vary with the type of area in which your proposed premises are located. PLEASE READ THESE INSTRUCTIONS CAREFULLY. INFORMATION REQUESTED AT THE TOP OF PAGE 1 AND THE BOTTOM OF PAGE 4 MUST BE SUPPLIED. SIGNATURE ON PAGE 4 MUST BE NOTARIZED. CERTIFICATION OF POPULATION The following information must accompany all applications requiring petitions: a. a U.S.G.S. map showing the population within the five (5) mile radius with the proposed premises as center. graphic designation on map showing general area where petition signatures were obtained. number of like type licenses within the five (5) mile radius noted on the map. a narrative and mathematical computation of how population totals were determined. REQUIREMENTS FOR PETITION (AS 04.11.460) 1. A new license or the transfer of location of an existing license may not be approved by the board in an area outside but within 50 miles of the boundaries of a municipality unless a petition asking that the license be issued or transferred within the area containing signatures of a majority (over 50%) of the permanent residents residing within one (1) mile of the proposed premises is filed with the board. A license may not be issued in an area which is 50 miles or more from the boundaries of a municipality unless a petition asking that the license be issued within the area containing the signatures of two-thirds (2/3) of the permanent residents residing within a radius of five (5) miles of the United States Post Office station nearest to the proposed licensed premises is filed with the board. If: b. c. d. 2. 1 American LegalNet, Inc. www.FormsWorkflow.com a. there are two or more United States post office stations in the vicinity of the proposed licensed premises, the nearest to the premises constitutes the point of beginning under this subsection. there is no United States post office within a radius of five (5) miles of the proposed licensed premises, the applicant must obtain the signatures of two-thirds (2/3) of the permanent residents residing within a five (5) mile radius of the proposed licensed premises. b. "Permanent resident" means a person 21 years of age or older who has established a permanent place of abode. AS 04.11.460(c) A new license may not be issued or an existing license relocated if after issuance or relocation there would be more than one restaurant or eating place license for each 1,500 population or fraction of that population, or more than one license of each other type for each 3,000 population or fraction of that population in a radius of five (5) miles of the licensed premises or the location of premises sought to be licensed.
