IN THE CIRCUIT COURT FOR FLORIDA IN RE: ESTATE OF File No. Division Deceased. COUNTY, PROBATE DIVISION ORDER DETERMINING SPOUSE'S ENTITLEMENT TO ELECTIVE SHARE This matter has come before the court sua sponte for consideration and the court finding that: 1. An Election to Take Elective Share has been timely filed by the decedent's surviving spouse, or by a person authorized by law to file that election on behalf of the surviving spouse; 2. Notice of this Election has been served by the personal representative on all interested persons and proof of that service has been filed; 3. No timely objection to this Election has been filed by any interested person; and 4. All conditions precedent to the surviving spouse's entitlement to elective share have been met; it is ADJUDGED that the surviving spouse is entitled to an elective share from the elective estate and the personal representative shall file and serve a petition to determine the amount of the elective share as required by Fla.
