SUPERIOR COURT OF CALIFORNIA, COUNTY OF LOS ANGELES INFORMATION RE: CASES REFERRED TO ALTERNATIVE DISPUTE RESOLUTION (ADR) JOHN A. CLARKE, EXECUTIVE OFFICER/CLERK ALTERNATIVE DISPUTE RESOLUTION (ADR) DEPARTMENT The Los Angeles Superior Court Alternative Dispute Resolution (ADR) Program is governed by Code of Civil Procedure, sections 1141.10-1141.31 and 1775-1775.15; California Rules of Court, rules 3.810-3.830, 3.850-3.860, 3.865-3.872 and 3.890-3.898; Evidence Code, sections 1115-1128; and Local Rules, rule 3.252 et seq. ADR Clerk This referral has been assigned to the ADR Clerk located at the following courthouse: (ADR location and telephone number drop-down menu) Initiating The ADR Process Upon referral to ADR, the parties must immediately: 1. Complete the ADR intake forms a. ADR Case Referral Intake (LAADR 039), and b. ADR Demographic Information (LAADR 011) One sheet must be completed for each litigant named in the action. 2. Submit completed forms in person, by fax (Local Rules, Rule 2.22,), by U.S. Mail, or by e-mail to the ADR office at the courthouse listed above. The ADR referral will not be processed unless all forms are properly completed and submitted to the ADR office listed above the earlier of: a. Within ten days of the date on the notice of referral or b. 60 days before the mediation completion date and 90 days before the arbitration or neutral evaluation completion date. Neutral Selection Party Select Panel The parties may select the neutral of their choice from the Party Select Panel on the Court's ADR website (www.lasuperiorcourt.org/adr). The parties may select two agreed upon neutrals in the event of a conflict or unavailability, and write the names of the neutrals on the ADR Case Referral Intake in order of priority. Random Select Panel The ADR staff assigns one neutral from the Random Select Panel on the Court's ADR website (www.lasuperiorcourt.org/adr). Upon entering the type of ADR process requested, area of law, jurisdiction, location, and if appropriate, special needs, the system will select one neutral who meets the criteria. If the parties decide to select a private neutral after initially selecting a neutral from the court's panel, plaintiff's counsel must immediately notify the neutral and ADR Department that the parties will not require the services of the court panel. (Local Rules, rule 3.255) ADR Completion Date The Court sets a completion date at least 60 days for mediation and 90 days for arbitration from the date of court's referral. Documents related to cases going through private ADR, binding arbitration, contractual arbitration, mandatory fee arbitration, etc., are to be filed directly with the Clerk's Office, or assigned courtroom. Filed directly with the Clerk's Office or referring courtroom: o Motion to Extend ADR Completion Date o Notice or Order Extending ADR Completion Date* o Notice or Order Removing Case from ADR* o Stipulation Re Settlement LAADR 038 o Request for Dismissal* Judicial Council of California CIV-110 o All other papers (i.e., motions, orders to show cause, etc.) related to the case *With a copy to the ADR Clerk.
