Form B3B (Information AOB3B1) (10/05) APPLICATION FOR WAIVER OF THE CHAPTER 7 FILING FEE FOR INDIVIDUALS WHO CANNOT PAY THE FILING FEE IN FULL OR IN INSTALLMENTS The court filing fee for filing a case under chapter 7 of the Bankruptcy Code is $299. If the debtor(s) cannot afford to pay the full filing fee at the time of filing, the debtor(s) may apply to pay the fee in installments. A form, which is available from the bankruptcy clerk's office or accessible through the court's website www.tnwb.uscourts.gov, must be completed to make that application. If the application to pay in installments is approved, the debtor(s) will be permitted to file the petition, completing payment of the fee over the course of four to six months. If the debtor(s) can not afford to pay the fee either in full at the time of filing or in installments, then a request to waive the filing fee may be tendered. Official form B3B, pages 2-4, must be completed and filed with the Clerk of Court. The assigned judge will decide whether the debtor(s) must pay the fee and an order will be entered by the court in each situation. By law, the assigned judge may waive the fee only if the income of the debtor(s) is less than 150 percent of the official poverty line applicable to the family size of the debtor(s) and the debtor(s) can not pay the fee in installments. Filers interested in this process may obtain information about the poverty guidelines at www.uscourts.gov. Required information: Complete all items in the application, and attach requested schedules. The application must be signed in accordance with the guidelines for electronic filing or with an original signature on a paper submission made by pro se debtor(s).
