NORTH CAROLINA COUNTY OF WAKE IN THE GENERAL COURT OF JUSTICE DISTRICT COURT DIVISION FILE NO. ___________________ ___________________________________, Plaintiff, v. ___________________________________, Defendant. NOTICE OF FINANCIAL INFORMATION REQUIRED Pursuant to Rules 6, 9, and 10 of the Wake County Family Court Rules -- Domestic, in all cases involving child support, post-separation support, and/or alimony, both parties shall file and exchange a Financial Affidavit (WAKE-DOM-10). Pursuant to Rules 10 and 11 of the Wake County Family Court Rules -Domestic, in all cases involving child support, post-separation support, and/or alimony, and in all cases involving equitable distribution, every party to an action has a duty to provide certain information and documents (Initial Disclosures) to the other party or their counsel of record without awaiting a formal discovery request. FINANCIAL AFFIDAVIT: Moving Party: The moving party shall serve his/her completed Financial Affidavit (WAKE-DOM­10) on the opposing party within fifteen (15) days of the filing of his/her claim. Opposing Party: The opposing party shall serve the moving party with his/her completed Financial Affidavit within fifteen (15) days of the date he/she is served with the claim. INITIAL DISCLOSURES REGARDING FINANCIAL ISSUES: Moving Party: The moving party who is seeking child support, post-separation support, and/or alimony has a duty to provide his/her Initial Disclosures (Support) fifteen (15) days after filing of his/her complaint, claim or motion for support. In no event will the party seeking support provide the Initial Disclosures less than ten (10) business days before any scheduled hearing. The party first filing a claim for equitable distribution is required to provide his/her Initial Disclosures (Equitable Distribution) within thirty (30) days of filing the claim for equitable distribution. Opposing Party: The party from whom child support, post-separation support, and/or alimony is claimed will provide his/her Initial Disclosures (Support) within fifteen (15) days of service of the complaint, claim or motion. In no event will the party from whom support is claimed provide the Initial Disclosures less than ten (10) business days before any scheduled hearing. The responding party to an equitable distribution claim or counterclaiming for equitable distribution (i.e. second to file) is required to provide his/her Initial Disclosures (Equitable Distribution) within thirty (30) days of service of the initiating party's complaint, claim or motion for equitable distribution.
