McCOLLUM, JUDGE APPENDIX C CONSENT TO PAYMENT OF ATTORNEY FEES ON PARTIAL ACCOUNT Estate of______________________ ___________________ Case No. _________________ The undersigned, being an heir, devisee, or legatee of this estate has been advised by the attorney for the estate that the attorney is requesting the payment of ___________________ in attorney fees on a partial account. The undersigned has further been advised that the above attorney fee represents payment for approximately ______% of total attorney work that will need to be performed in this estate. The undersigned acknowledges that he/she is aware that additional fees ____will be or _____will not be requested at a later date. The undersigned has been further advised that the Rules of Superintendence of the Ohio Supreme Court do not allow for the payment of attorney fees on a partial account unless the attorney obtains the approval of the Probate Court. In order to obtain the approval of the Probate Court, the attorney would have to file an itemized application for attorney fees with the Court. The application would have to set forth cause for this payment of these fees on a partial and not a final account.
