CRIMINAL FORM 9-309 Supreme Court Approved 5/16/899-309 [For use with District Court Rule 5-406, Magistrate Court Rule 6-406, Metropolitan Court Rule 7-406 and Municipal Court Rule 8-406] STATE OF NEW MEXICO [COUNTY OF___________________] [CITY OF_____________________] __________________________ COURT No. ___________[STATE OF NEW MEXICO] [COUNTY OF __________________] [CITY OF ____________________] v. ________________________________, Defendant and ______________________________, (surety) ______________________________, (surety) DEFAULT JUDGMENT ON BOND (Not to be used for Cash Bonds) This matter coming on for hearing before this court, THE COURT FINDS: The defendant [and the defendants sureties] previously signed an [appearance] [bail]bond agreeing that the defendant would appear at such times and places as may be requiredby this court; The defendant [failed to appear as required] [violated a condition of the bond]; This court served a Notice of Forfeiture and Order to Show Cause on the clerk of thecourt forfeiting the defendants bond more than thirty (30) days prior to this hearing; The clerk of the court mailed to the defendant [and the defendants sureties] theNotice of Forfeiture and Order to Show Cause why default judgment should not be enteredon the forfeited bond; The forfeited bond has not been set aside, the defendant has not been surrendered intocustody and good cause has not been shown why default judgment should not be entered. IT IS, THERE FORE, ORDERED, ADJUDGED AND DECREED that the defendantand his sureties are jointly and severally liable for the payment of the bail bond into this courtin full.
