Notice (Emergency only) That based on the evidence presented to this court, it is unlikely the Respondent will cause harm or abuse and/or will improperly dispose of, or damage personal property, if given prior, or grea ter notice of Petitioners efforts to obtain judicial relief. Exclusive Possession That based on the evidence presented to this court, it is unlikely that the Petitioner will be in immediate danger of furt her abuse should s(he) choose to remain in the residence or household and/or that the hardship to the Respondent would substantially outweigh the hardship to the Petitioner from denial of the remedy. 214 Requirements The Respondent has not committed ab use as defined by the IDVA and/or Respondent has not improperly dispos ed of or damaged personal property. Service/Appearance The Respondent has not been served with a Summons and a copy of the Petition for Order of Protection or has not filed a general appearance.
