FINANCIAL IDENTITY THEFT ORDER This matter coming before the Court pursuant to 720 ILCS 5/16G-30 for hearing on Petitioners Petition for Expedited Judicial Determination of Factual Innocence, the Court being f ully advised finds as follows: 1. Petitioner ______________________________________ is a victim of financial identity theft. The perpetrator of the financial identity theft was arrested for, cited for, or convicted of a crime under the Petitioners identity; or a criminal complaint was filed against the perpetrator in the Petitioners name; or the Petitioners identity has been mistakenly associated with a criminal conviction, in the above case. 2. The Court determines that there is no reasonable cause to believe that the Petitioner committed the offense for which the perpetrator of the identity theft was arrested, cited, convicted, or subject to a criminal complaint in the Petitioners name. 3. The Court determines that the Petitioners identity has been mistakenly associated with a record of criminal conviction. IT IS HEREBY ORDERED: A. The Petitioner is factually innocent of the charges listed on this form and the Petition for Expedited Judicial Determination of Factual Innocence is granted. B. The Clerk of the Circuit Court shall seal, delete, or label the name and associated personal identifying information contained in the court records, files and indexes accessible to the public, to show that the dat a is impersonated and does not reflect the Petitioners identity.
