The plaintiff in this cause is the custodian of the child(ren) named below in No. 2 and is now receiving or has received public assistance toward the support of the below named minor child(ren) from the State of Alabama, Department of Human Resources, and has assigned by operation of law, support rights in regard to child(ren) to the State of Alabama, Department of Human Resources. These payments are an obligation due to the State of Alabama; OR G b. Plaintiff in is now receiving services from the State of Alabama for the enforcement of support pursuant to Title IV-D of the Social Security Act, as amended. 2. This is a civil proceeding governed by the Alabama Rules of Civil Procedure. Under these rules of court, you are REQUIRED TOFILE A WRITTEN ANSWER TO THE PETITION WITH THE CLERK OF THE COURT ON OR BEFORE THE DATE SHOWN ON THEATTACHED SUMMONS. If you or your attorney fail to deliver or mail your written answer so that it will be received in the clerks officeon or before that date, or if you fail to appear at a hearing set in this case, a Judgment by Default may be entered against you which mayfind that you have a legal duty to pay child support as long as the child(ren) is/are under the age of nineteen (19), or, longer if thechild(ren) is/are disabled, and spousal support (where applicable). If the Court establishes in this case that you have a legal duty to support the minor child(ren) and your spouse or former spouseunder Alabama law, the court must enter a Withholding Order for Support. If it becomes necessary to serve this Withholding Order uponyour employer/the Department of Industrial Relations, the amount ordered by the Court for support will be deducted from your wages,salary or benefits as long as you are required to make support payments.
