The Office of the Friend of the Court has reviewed your files and determined there is an arrearage of: Defendant name, address, and telephone no. 3. All payers are subject to income withholding unless otherwise ordered by the court. Past due support is assessed a surcharge of 8% annually.4. The following enforcement actions are being taken: a. Your income is subject to income withholding in the amount of $ per . The income withholding is effective and notice to withhold will be sent to your source of income. The income withholding will be applied to current and subsequent employers and periods of employment and other sources of income. You may request a hearing within 21 days of the date of this notice to contest the withholding. b. Your arrearage exceeds two months obligation. The amount of the arrearage stated in this notice can be reported to credit reporting agencies unless you pay the entire arrearage or request a hearing within 21 days after the date of this notice. c. Your arrearage exceeds two months obligation. Your drivers, occupational, sporting, and recreational licenses will be suspended. A suspension order will be entered and sent to the licensing agency unless you pay the arrearage or request a hearing within 21 days after the date of this notice. 5. You may request a hearing to contest the enforcement action only on the grounds that the enforcement action is not proper because of a mistake of fact concerning the amount of the current or overdue support or the identity of the payer. For a proposed license suspension, you may also request a hearing to suggest a schedule for the repayment of the arrearage. If this hearing is held before a referee, you have a right to a de novo hearing before a circuit court judge. Contact the friend of the court to find out how to request a hearing. 6. If you think the amount of support should be changed, you may file a motion with the court to modify the support order. 7. Every time you change employers, you must report the name, address, and telephone number of that employer to the friend of the court in writing. 8. Other enforcement remedies are available to assist in collection of support, including but not limited to: The friend of the court may move the court for an order to show cause, which will require you to appear before the court and show cause why you should not be held in contempt. If you fail to appear for the hearing on the show cause, the court may issue a bench warrant for your arrest and may assess costs against you. Liens exist by operation of law against your real and personal property, including accounts with financial institutions. If your arrearage exceeds the amount of periodic support payments payable for two months under your support order, your real or personal property can be encumbered or seized. When your arrearage equals $150, your tax refund may be taken and used to pay part of your arrearage. When your arrearage equals $5000, your passport can be denied or revoked. Your name and arrearage can be published, or posted on the Internet. 9. Federal and Michigan criminal laws provide that under certain conditions it is a felony to fail to pay support.
